Employment is a contract between two parties, one being the employer and the other being the employee. An employee may be defined as: "A person in the service of another under any contract of hire, express or implied, oral or written, where the employer has the power or right to control and direct the employee in the material details of how the work is to be performed." Black's Law Dictionary page 471 (5th ed. 1979).

In a commercial setting, the employer conceives of a productive activity, generally with the intention of generating a profit, and the employee contributes labour to the enterprise, usually in return for payment of wages. Employment also exists in the public, non-profit and household sectors. To the extent that employment or the economic equivalent is not universal, unemployment exists.

How do I get unemployment when employer lied and there was no wilful misconduct on my part?
Q. Employer set me up and fired me while on medical leave and said it was with cause. There was no wilful misconduct on my part and employer is embellishing their reasons for their actions. I want to sucessfully state the case when I fill out the unemployment forms. There must be a way to get unemployment when fired and employer is falsifying the reason. One reason stated is that I did not make significant improvements to my performance after a review with some negative comments on it. I was not on probation, no required improvements or any timeframe was stated on the review, and a newly employed supervisor fired me after I was on already on medical leave for 2 weeks. A. Just apply for it and tell the truth. Companies always try to get unemployment benefits denied because they have to pay them. Bottom line is, the unemployment department will have an inquiry and if you are in the right, you will get your benefits. The company is lying and you will win. Just don't lie, tell the truth.

How important are past employer referrals when applying for jobs?
Q. I have been working for the same company for 4 years now and am considering searching for a new job. I left my last job on bad terms and know they would answer no to the question of whether they would hire me again. I can get a letter of recommendation from my current employer, but wondering how much the past employer can affect my chances for finding a new job. Anyone have any thoughts on this? I know that past employers aren't allowed to give specifics about your job performance, but they can answer the question of whether or not they would rehire you.

A. Well, if you get a good ref from your current employer, and you've been there 4 years, the old employers comments won't carry much weight anyway. Everyone's got a job in their past where they didn't fit. If you fit fine in this current job, and the one's before the previous one, you should be fine

A. Yes, it is legal. Someone else asked this question within the past week or so...you can do a search and review the answers to their question too. Its not uncommon these days for an employer to require that a spouse also be enrolled on their own employer's benefit plan (if available) as primary. Often, the employer has to choose between doing that or slashing the benefit package for everyone...obviously, requiring a spouse to enroll as primary under their own plan would be better for the majority of people vs. slashing everyone's benefits. My own employer actually has that requirement - a spouse must enroll in their own coverage, if their employer makes single coverage available to them for under $120 a month.
