An employee may be defined as: "A person in the service of another under any contract of hire, express or implied, oral or written, where the employer has the power or right to control and direct the employee in the material details of how the work is to be performed." Employer set me up and fired me while on medical leave and said it was with cause. There was no wilful misconduct on my part and employer is embellishing their reasons for their actions. I want to sucessfully state the case when I fill out the unemployment forms. There must be a way to get unemployment when fired and employer is falsifying the reason. One reason stated is that I did not make significant improvements to my performance after a review with some negative comments on it. I was not on probation, no required improvements or any timeframe was stated on the review, and a newly employed supervisor fired me after I was on already on medical leave for 2 weeks. Its not uncommon these days for an employer to require that a spouse also be enrolled on their own employer's benefit plan (if available) as primary. Often, the employer has to choose between doing that or slashing the benefit package for everyone...obviously, requiring a spouse to enroll as primary under their own plan would be better for the majority of people vs. slashing everyone's benefits.
